His lawyer has discussed that the tweets were not opposite the court itself but somewhat the personal behaviour of the judges. In an affirmation to the court, Mr Bhushan said that to "critique the works of the chief justice, or a continuation of chief justices, cannot and does not offend the court, nor does it overcome the authority of the court".

"To pretend or suggest that 'the chief justice of India is Supreme Court, and the Supreme Court is the chief authority of India' is to undermine the organization of the Supreme Court of India," he declared.
He also wrote that the "freedom of representation and the concomitant right to criticize includes a robust criticism and fair of the judiciary. This cannot amount to the shame of court or lowering the dignity of court in any custom".
India has some of the world's strictest shame of the court laws. Those who have been guilty of them include a sitting high court judge, CS Karnan, business tycoon Vijay Mallya and author Arundhati Roy.
