Erika Girardi was "intimately involved in Girardi & Keese's business dealings," according to a new $2.1 million lawsuit, and was aware that victims were "funding her notoriously lavish lifestyle."

Erika Girardi is facing yet another legal battle due to her estranged husband Tom Girardi's alleged embezzlement. "The complaint is yet another misguided attempt to hold Erika accountable for the actions of others in which she had no control," Erika's attorney Evan C. Borges says in a statement.

Borges adds, "Erika has no law degree and has never worked at or managed her ex-law husband's firm." "Erika had no knowledge or role in anything Mr. Girardi or others at his law firm did or said to the plaintiffs in this case. Mr. Girardi, his law firm, and anyone who helped him should be held accountable. 

Erika "knew about the scheme" by which Tom allegedly withheld money due to clients and co-counsel, according to the lawsuit buffed on behalf of attorney Manuel H. Miller and Kathleen Bajgrowicz, mother of late NFL star Chuck Osborne. The latter died after repeated head trauma in 2012. It also claims that she knew that the victims were "funding her notoriously lavish lifestyle," as depicted on RHOBH. 

Tom and Miller agreed to split the fees when they represented Bajgrowicz in her lawsuit against the NFL for her son's death. Tom was in charge of distributing funds to Bajgrowicz and Miller after settling with the league. Still, they claim he "lulled Plaintiffs into believing that the funds could not be distributed to anyone until various issues were first resolved."

"Defendants knew Plaintiffs were fraud victims but did nothing to protect them and instead prioritized their financial gain at Plaintiffs' expense," according to the suit. "Defendants should be required to compensate Plaintiffs for the harm they have caused and punished for assisting and abetting Girardi's breach of fiduciary duty and financial elder abuse of Plaintiffs."
